PLEASE REVIEW THESE TERMS OF USE (“TERMS” OR “AGREEMENT”) CAREFULLY BEFORE USING OUR WEBSITE, APP, OR SERVICES (ENDOMONDO.COM, ENFIT, OR OUR ONLINE COACHING AND E-COMMERCE BUSINESS). BY USING THIS SITE, APP, OR ANY RELATED SERVICES, YOU CONFIRM YOUR ACCEPTANCE OF THESE TERMS. IF YOU DO NOT AGREE, PLEASE DO NOT ACCESS OR USE OUR SERVICES.

Endomondo.com, the Enfit fitness app, and our online coaching and e-commerce services are owned and operated by Enfinify Holding LLC, a Delaware limited liability company (“Enfinify,” “we,” or “us”). Accessing or using Endomondo.com, the Enfit app, or purchasing our physical or digital products, or subscribing to coaching services signifies your agreement to these Terms. Should you disagree with any part, please exit Endomondo.com, discontinue use of the app, and refrain from purchasing any services or products immediately.

When using our services—including our fitness app, coaching programs, e-commerce store, and fitness articles—you are subject to any specific guidelines, policies, and rules relevant to these features, which are incorporated into this Agreement by reference. Enfinify reserves the right to modify these Terms, the site, the app, or its services as needed. Your continued use of our services after any changes constitutes acceptance of those changes.

Acknowledgement

This Agreement is between you and Enfinify, not Apple Inc. (“Apple”). Enfinify, not Apple, is solely responsible for Enfit, its content, and related services, including our online store and coaching programs. Your use of this application must comply with Apple’s Media Services Terms and Conditions, which you acknowledge having had the opportunity to review.

Scope of Services

These Terms apply to all services provided through Endomondo.com, the Enfit app, our e-commerce store, and online coaching business, including but not limited to:

The Enfit fitness app, which offers guided workouts, and progress analytics.
Online coaching services, which provide personalized training, virtual coaching sessions, and wellness programs.
E-commerce store, where we sell physical products (fitness apparel, accessories, workout gear, supplements, and related items) and digital products (eBooks, workout plans, nutrition guides, and training programs).
Fitness content, including articles, guides, and expert advice available on Endomondo.com.

The license granted to you for using Enfit is a non-transferable, non-exclusive license to install and use the app on Apple-branded devices that you own or control, as permitted by the Usage Rules outlined in Apple’s Media Services Terms and Conditions. Family Sharing and volume purchasing allow access to other associated accounts.

Maintenance and Support

Enfinify is solely responsible for providing maintenance and support services for the Enfit app, online coaching, and e-commerce platform. Apple is not obligated to provide any maintenance or support services for the app or associated services.

Warranty Disclaimer

Enfinify is solely responsible for any warranties, express or implied, related to Enfit, online coaching services, and e-commerce products, to the extent not effectively disclaimed.

If Enfit or digital products fail to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price for Enfit (if applicable). To the maximum extent permitted by law, Apple will have no further warranty obligations with respect to Enfit. Any other claims related to failure to conform to a warranty are Enfinify’s sole responsibility.

Enfinify does not guarantee specific results from fitness coaching, workout plans, or product purchases, as individual results may vary.

Product Liability

Users understand that fitness activities, online coaching, and product usage involve inherent risks, including injury or health complications. Enfinify is not responsible for third-party product outcomes, injuries from coaching or workouts, or user actions.

Enfinify, not Apple, is responsible for addressing any claims related to the Enfit app, coaching services, or e-commerce transactions, including:

Product liability claims related to fitness gear, supplements, or accessories.
Claims that the app, coaching services, or store products fail to conform to legal or regulatory requirements.
Claims under consumer protection, privacy, or similar laws.

Age Requirements

Endomondo.com, Enfit, online coaching, and e-commerce services are intended for users who are 16 years of age or older. Minors must have parental consent to use these services, and parents or guardians are responsible for overseeing minor usage.

Intellectual Property Rights

All content on Endomondo.com, Enfit, online coaching, and e-commerce store, including text, graphics, trademarks, logos, and other intellectual property, is owned by Enfinify or its licensors.

Users may access this content solely for personal, non-commercial use. Unauthorized use, reproduction, or redistribution is prohibited.

If a third-party claim arises alleging that Enfit, coaching services, or digital products infringe intellectual property rights, Enfinify is solely responsible for investigating, defending, settling, or resolving such claims, not Apple.

Purchases, Subscriptions & Refunds

Physical & Digital Product Purchases

Physical products may be returned within 30 days, provided they are unused and in original packaging.
Digital products cannot be refunded once delivered or accessed.

Coaching & Subscription Services

Coaching sessions must be booked in advance.
Coaching cancellations require at least 24 hours’ notice for partial refund or rescheduling.
Subscription-based services auto-renew unless canceled before the next billing cycle.

In-App Purchases & Subscriptions via Apple App Store

Payments for App Store purchases are processed by Apple and charged to your Apple ID payment method.
Apple handles refund requests for App Store purchases.
To cancel or manage subscriptions, users must do so via their Apple ID settings under:
- Settings > Your Name > Subscriptions

Enfinify is not responsible for billing issues related to App Store purchases. Users must contact Apple Support for in-app purchase refunds or issues.

Linking Policy

The following organizations may link to Endomondo.com without prior written approval:

Search engines
News organizations
Online directories linking similarly to other business websites
Accredited businesses, excluding soliciting non-profits and fundraising groups

These organizations may link to our home page or other site pages, provided the link is not deceptive, does not falsely imply sponsorship, endorsement, or approval, and fits within the context of the linking party’s site.

Affiliate Disclaimer

We may use affiliate links on Endomondo.com, Enfit, and our store to recommend products or services. Clicking on these links and making a purchase may earn us a commission at no extra cost to you.

These links lead to third-party sites that we do not control, and we are not responsible for their content, products, or services. Users should review third-party terms and privacy policies before engaging with them.

Legal Compliance

Users represent and warrant that they:

Are not located in a U.S.-sanctioned country or a country designated as “terrorist-supporting” by the U.S. government.
Are not on any U.S. government list of prohibited or restricted parties.

Account Registration and Security

Users can register accounts exclusively through the Enfit app. Users must maintain the confidentiality of their account information and are responsible for all activities conducted under their account.

Limitation of Liability

Enfinify is not liable for any injuries, health issues, or damages resulting from the use of fitness-related content, coaching services, or product purchases on Endomondo.com, Enfit, or our store. Users assume all responsibility for participating in exercises or wellness activities suggested through our services.

Users should consult with a healthcare provider before starting any new fitness program, especially if they have pre-existing health conditions.

Indemnification

Users agree to indemnify and hold Enfinify harmless from any claims, losses, liabilities, damages, and costs (including legal fees) arising from:

Their use of our site or app
Their violation of these Terms
Any activities conducted under their account

Third-Party Terms of Agreement

Users must comply with applicable third-party agreements when using our services.

Third-Party Beneficiary

Enfinify and the End-User acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of this Agreement. Upon accepting these Terms, users agree that Apple has the right to enforce this Agreement against them.

User Comments Policy

Endomondo.com allows users to post text-based comments only. By posting a comment, you agree that:

You are solely responsible for your comments. Enfinify does not assume liability for user comments and does not endorse any opinions, statements, or claims made by users.
You will not post comments that:
- Are unlawful, defamatory, abusive, harassing, threatening, fraudulent, misleading, or obscene.
- Contain hate speech, discrimination, or incite violence.
- Violate any third party’s intellectual property rights.
- Contain spam, advertisements, or self-promotion.
- Include malicious links, software, or any form of digital threat.
Enfinify reserves the right to remove or moderate comments at its discretion, especially those violating these Terms.
Enfinify may disclose user comments if required by law or in response to legal authorities.

Violation of this policy may result in suspension or termination of your commenting privileges or account.

Termination
